Hi everyone
Please can someone help... Wife and 2 children applying for Indefinate Leave to Remain.
No-one seems to know which form to use.
Wife and 15 year old no problem, SET M form... I think.
But... other child is 18 years and at school.
UKBA told me on phone to use SET L form which doesn't exist. Then said maybe SET F or O.

Now I am totally confused!!!!

Does anyone know???????

Many thanks Cliff

Hi Cliff. Welcome to the forums (aka mad house)

All of the different settlement applications forms are listed here:

http://www.ukba.homeoffice.gov.uk/visas-immigration/settlement/appl...

It is clear that your wife applies with SET(M) and your 15 year old SET(F). Where it is not clear is the 18 year old who is now classed as an adult, but was a juvenile when granted FLR. Looking at the different criteria for the application forms I would use form SET(F). If you use the checking service or better still, use one of the Public Enquiry Offices (PEO) to submit your application, they will confirm the right form has been used.

I wouldn't worry. Good luck.

Thanks for the feed back David.

The checking service when I called them could confirm which form and told me they were only contracted to check SET M forms.

As mad as you reckon, its really appreciated that some people take the time to help others.

If you can afford the extra, always always use a PEO to submit your applications. The fact that the decision is made there and then and you get all your documents back straight away is worth it's weight in gold...

Apologies that I couldnt help Cliff. I have experience of the SET(M) but the answer to an 18y.o was outside my knowledge. I knew that one of the gang would come along and throw some light on it.

welcome to the Forum chap.

Yes. The guidance notes on Form SET(M) states:

3 WHO MAY APPLY ON THIS FORM?

You and your children under 18 if they are applying as your dependants.

Children aged 18 or over may not be included; they must each apply individually and pay the specified fee, as must any children under 18 if there is some reason preventing them from applying with you.

I also just double checked the Q&A section for SET(M). It clearly states which form is for who:

CAN I INCLUDE MY DEPENDANTS IN MY APPLICATION?

You can use one form for a joint application by you and any children aged under 18, if they are applying as your dependants. Children over 18 must apply separately, using application form SET(F).

So, it's SET(M) for your wife and 15 year old, SET(F) for the 18 year old.

Following on from the link posted previously...

"...Form SET(F) is for settlement applications by family members (except partners) of British citizens or people who are settled here. You can apply using form SET(F) if you are:

* a child aged under 18 of a parent, parents or a relative who is a permanent resident of the UK and currently living here;
* the adopted child aged under 18 of a parent or parents who are permanent resident of the UK and currently living here; or
* the parent, grandparent or other dependant relative aged 18 or over of a person who is a permanent resident of the UK and currently living here...."

If I read this correctly, the 18 year old must be a dependant.
